Searches at two foundations

Prosecutors from Zespół Śledczy nr 4 of the National Prosecutor's Office (Prokuratura Krajowa) entered two Warsaw foundations at the same time on the morning of Friday, 30 October. The first is the Instytut Polski Suwerennej, described as the political support base of former justice minister Zbigniew Ziobro. The second is the Dobre Państwo foundation, set up by Confederation MP Przemysław Wipler. Spokeswoman Anna Adamiak confirmed to the press that the searches were being carried out on the order of that team, and at the time of her confirmation they were still under way. Both foundations had received money from the Zondacrypto crypto exchange.

Payments from the exchange

Reporting by TVN24 and naTemat links both foundations to payments from the head of the exchange, Przemysław Kral. Ziobro told TVN24 and Wirtualna Polska that he personally asked Kral for a large cash injection for his foundation, a sum of 450,000 zł. According to naTemat, former CBA agent Artur Chodziński acted as courier and negotiator in that transaction. Wipler argues that his campaign against the crypto-assets law was only a coincidence, according to the same outlet. The two foundations therefore share a common link, the transfers from the exchange's head, although the articles describe the two politicians' positions differently.

The probe behind the searches

The investigation into Zondacrypto has been running since April and concerns suspected fraud and money laundering. Victims had already reported damage of at least 350 million zł by April, and several thousand notifications of crime have since been filed. The inquiry also covers money and crypto flows and the circumstances of the disappearance of Sylwester Suszek, founder of BitBay, the predecessor of Zondacrypto. Since 1 October a special team of the National Prosecutor's Office has handled the case, and within it former PKOl head Radosław Piesiewicz has been arrested.

Seized assets

On Friday, 23 October, police in Katowice secured 11 luxury cars worth about 4 million zł that belong to one of the suspects. In total about 125 million zł has been secured in the proceedings so far. Part of those assets is tied to other threads of the case and does not come from gains made at the expense of exchange clients. Adamiak said:

“This means that not all of the seized assets may be used to satisfy the claims of defrauded exchange customers.”

Anna Adamiak

Part of the roughly 125 million zł therefore belongs to other threads of the case, which limits how much can go to victims.

Current status

The reports do not yet give any findings from the searches at the two foundations. The Zondacrypto case now combines searches of politically linked foundations with asset seizures and arrests. Adamiak, who serves as spokeswoman for the Prosecutor General, confirmed the searches on the record.
