Sejm committee to take up supplemented motion to put Ziobro before State Tribunal
The Sejm Committee on Constitutional Responsibility will take up a supplemented motion filed in mid-September, at a Sejm sitting planned for 20-23 October. Serving the motion on Ziobro, who is in the United States, could take several months.
Supplemented motion returns to committee
On Monday, 12 October, Lewica MP Tomasz Trela told Radio Zet that the Sejm Committee on Constitutional Responsibility will now take up a supplemented motion for a State Tribunal (Trybunał Stanu) referral of former justice minister Zbigniew Ziobro. Trela described two separate liabilities in the case.
Now we will be dealing with the supplemented motion for a State Tribunal motion for Zbigniew Ziobro. Here there is one criminal liability for the Pegasus system and the Justice Fund, and the second is constitutional.
The motion was filed in April 2026 by Jarosław Urbaniak (KO), with signatures from MPs of KO, Lewica, PSL, Polska 2050 and Centrum. In July the committee found it did not meet the requirements, and the charge of founding and leading an organised criminal group was removed. Unofficially, that change followed a legal opinion by Hubert Izdebski, which indicated that the conduct is not a constitutional delict. Radio Zet reports that the revised motion was filed in mid-September, and Trela said on Monday that he had not yet reviewed it.
Glapiński motion adopted first
On Friday, 9 October, the committee adopted a report on a preliminary motion to bring National Bank of Poland president Adam Glapiński before the State Tribunal. It backed holding him to constitutional responsibility, and Radio Zet reports that it recommended the Sejm put him before the tribunal. Radio Zet reports that the committee's next case concerns Ziobro. Trela referred to that earlier report on Monday, 12 October, on Radio Zet.
Timing and delivery
Zdzisław Gawlik, the KO MP who chairs the committee, told Radio Zet how the process will proceed.
The committee will consider the motion at its next Sejm sitting, most likely on 20 or 21 October. Later, under the law, it must be effectively delivered to the person it concerns. That person has 30 days to respond to the content of the motion and to name their representatives.
Delivery is expected to be the harder step. Radio Zet reports that Ziobro is in the United States, where he is officially a correspondent for Telewizja Republika, and describes him as hiding from prosecutors there. Its committee sources point to two main obstacles, establishing where he lives and serving the letter effectively. They say the process could take several months.
- Prosecutor General Waldemar Żurek notifies Sejm Marshal Włodzimierz Czarzasty of the charges against Ziobro
- Sejm consents to Ziobro's detention and temporary arrest
- Motion to put Ziobro before the State Tribunal filed by Jarosław Urbaniak (KO)
- Committee finds the motion does not meet requirements and the organised criminal group charge is removed
- Supplemented motion filed in the Sejm
- Committee adopts report on preliminary motion against NBP president Adam Glapiński
- Trela says the committee will now take up the supplemented Ziobro motion
- Committee expected to consider the Ziobro motion, most likely on 20 or 21 October
Charges behind the motion
Rzeczpospolita reports that at the end of 2025 the Sejm consented to Ziobro's detention and temporary arrest, and that prosecutors issued a decision to present him with charges over irregularities in the Justice Fund. Prosecutors allege that as justice minister under PiS he led an organised criminal group and used his office for criminal acts, with 26 offences attributed to him. Those include ordering subordinates to break the law to secure Justice Fund grants for selected entities. Rzeczpospolita's headline refers to 51 charges, a figure its text does not repeat. In late November 2025, Prosecutor General Waldemar Żurek notified Sejm Marshal Włodzimierz Czarzasty of the charges and noted that the Sejm could consider whether the violations amount to a constitutional delict. Radio Zet reports that the dropped organised-crime charge was treated as an ordinary offence, for which prosecutors already pursue Ziobro.
Political backdrop
Radio Zet notes that Ziobro's name appears directly on the coalition's list of 100 concrete steps for the first 100 days of government, and that settling accounts with PiS politicians has moved slowly, though the pace picked up in the weeks before 12 October. The next formal step is the committee's consideration at the Sejm sitting planned for 20 to 23 October. The 30-day response period starts only once the motion has been served.
