Spain proposes outdoor smoking ban on beaches and restaurant terraces as part of new health bill
The left-wing government of Pedro Sánchez announced a bill to prohibit smoking and vaping in outdoor areas of hotels, restaurants, bus stops, university campuses, sports facilities, pools and beaches, though it lacks a parliamentary majority to pass it.
The proposed ban
Health Minister Mónica García announced the bill after a cabinet meeting on Tuesday. It would prohibit smoking and vaping in outdoor areas of hotels, cafés and restaurants, as well as at bus stops, train platforms, university campuses, sports facilities, swimming pools and beaches. The legislation also bans tobacco use by minors, outlaws all advertising for tobacco and vaping products, and imposes tight restrictions on the sale of e-cigarettes. Several Spanish regions already enforce similar outdoor smoking bans through local health authorities, but the new law would create a nationwide standard.

Health rationale
García said smoking causes approximately 50,000 deaths per year in Spain and is a contributing factor in nearly 30% of all cancer cases. The government's explicit aim is to move toward a "smoke-free generation" and to ensure that breathing clean air becomes the default in shared public spaces. The bill treats outdoor smoking as a serious public health risk, not merely a discomfort, and seeks to shield children and families from second-hand smoke in recreational areas.

Industry pushback
Spain's hotel and restaurant associations are expected to fight the measure fiercely. The country is the world's second most-visited tourist destination, and outdoor dining is deeply embedded in Spanish social life, particularly during the long, hot summers that are becoming more intense. Business owners warn that banning smoking on terraces could drive away customers and damage revenues in a sector that is a cornerstone of the national economy. The hospitality lobby is likely to argue that the restrictions are excessive and that existing indoor bans already protect non-smokers.
Current smoking landscape
Spain has made significant progress in reducing smoking rates, but the habit remains widespread. According to the most recent health authority study, from 2024, about 26% of the adult population still smokes daily. A 2011 law already prohibits smoking in all enclosed public spaces, including bars, restaurants, nightclubs and casinos. The new bill would be the most far-reaching anti-tobacco legislation since then, extending restrictions into the open air for the first time at a national level.
