Polish prosecutors request psychiatric detention for woman who confessed to killing husband
The District Prosecutor's Office in Mińsk Mazowiecki has requested the dismissal of criminal charges against Elżbieta P., seeking instead her mandatory placement in a psychiatric hospital.
The investigation in Mrozy
On 4 December 2025, 51-year-old Dariusz P., who owned a local petrol station, was found murdered in his home in the town of Mrozy in the Mazovia region. Law enforcement officers detained his wife, Elżbieta P., on 5 December 2025 and formally presented her with homicide charges. During three separate interrogations as a suspect, she admitted to killing her husband, though she exercised her legal right to refuse to provide detailed explanations. The couple's 17-year-old daughter was inside the family residence when the homicide occurred, though investigators noted that the teenager did not hear the attack.
Psychiatric evaluation and legal insanity
Because investigators observed questions regarding her mental state during the initial phase of the proceedings, the prosecution ordered a formal psychiatric and psychological assessment. Elżbieta P. underwent observation at a specialized medical facility so experts could evaluate her condition at the time of the act. Medical examiners concluded that she suffered from a mental illness that completely removed her ability to recognize the significance of her actions or direct her conduct. Under Polish criminal law, a finding of complete legal insanity precludes standard criminal culpability and prevents the case from advancing to a trial.
During the preparatory proceedings, due to justified doubts regarding the sanity of the suspect Elżbieta P., it was decided to seek the opinion of expert psychiatrists and a psychologist. She was directed to hospital observation. After its completion, expert psychiatrists and a psychologist diagnosed her with a mental illness. According to the experts' opinion, at the time of committing the alleged act, the suspect had an abolished ability to recognize the meaning of this act and direct her conduct.
Motion for secure confinement
On 30 September 2026, the District Prosecutor's Office in Mińsk Mazowiecki formally submitted a motion to the Regional Court in Siedlce to discontinue the criminal proceedings against Elżbieta P. The conclusion that she cannot stand trial does not result in her release into the community. Evaluators determined that her ongoing mental state carries a high risk of committing another unlawful act with severe social consequences. Prosecutors subsequently moved for the application of a protective measure that mandates her placement in a closed psychiatric facility.
In the assessment of the prosecution, these circumstances justify ordering a protective measure against Elżbieta P. in the form of placement in a psychiatric hospital, and such a motion has also been submitted to the court.
Judicial review and family aftermath
Under the requested court order, Elżbieta P. will remain in a secure psychiatric hospital, where medical panels will review her health every few months. She will only be eligible for release if a panel of psychiatric experts certifies that the symptoms of her illness have fully subsided. The homicide in December 2025 was accompanied by further events for the family. Four days after the murder of Dariusz P., on 8 December 2025, the couple's son died after throwing himself in front of a train at the railway station in Dębe Wielkie. Several months prior to that incident, a young woman named Angelika, with whom he had been in love, died at the same railway location.
