
Brzoska submits anti-scam report to Polish lawmakers, demanding 150% penalties on Meta ad fraud

Findings of the ScamWatch ad audit
InPost founder Rafał Brzoska and Bielik AI creator Sebastian Kondracki presented the initial results of their ScamWatch initiative on 21 September 2026. The monitoring project, launched in late August 2026, downloaded over 2 million promotional materials from Meta platforms in Poland and analyzed 1.76 million advertisements. The analysis identified 290,000 advertisements (16.5% of the total dataset) as suspicious and 28,000 advertisements as presenting very high criminal risks, including identity theft, financial pyramids, illegal gambling, and malicious software. Kondracki identified 12 distinct categories of scam active within the ecosystem, including deepfakes of public figures and deceptive investment schemes.
This is a factory of very suspicious advertisements with elements of scam, but also a group of advertisements that are harmful to recipients.
Proposed legal rules and financial penalties
Brzoska delivered printed copies of the report, titled "SCAM. 12 Types of Fraud. Proposals for Legal Changes", to all members of the Polish parliament, senators, and government ministers. The initiative put forward three statutory changes aimed at holding digital platforms accountable. First, platforms would be required to verify all advertisers prior to campaign launch using anti-money laundering (AML) and know-your-customer (KYC) standards similar to those applied by commercial banks. Second, the proposal establishes a 150% penalty rule, under which a platform broadcasting fraudulent advertisements must surrender 100% of the revenue earned from those ads and pay an additional 50% administrative penalty. Third, revenue collected from these fines would finance a dedicated compensation fund for victims who lost money or personal data to digital scams. A public petition backing strict platform penalties gathered over 167,000 signatures.
Meta has had the technology, money, and data to detect fraud for years. And yet scam remains massively present on its platforms. Why? Because it simply pays off.
Financial scale and European comparisons
Estimates from the Instrat Foundation, presented in the Polish parliament on 17 September 2026, indicate that Meta generates approximately 760 million PLN annually in Poland from fraudulent advertising, alongside 1.274 billion PLN from other advertising campaigns. These figures mean that fraudulent ads account for roughly 37% of Meta's Polish advertising revenue. Data cited in the report from Bitdefender Labs shows that Poland accounts for 18% to 20% of all detected fake investment ads on Meta platforms in Europe, ranking ahead of Italy at 15% to 17%, and Spain and France at 11% to 13% each. Banking sector figures from Piotr Brewiński of Fintech Poland show commercial bank clients in Poland lose nearly 850 million PLN annually to fraud, with the National Bank of Poland recording 260 million PLN in losses during the first quarter of 2026 alone.

Allegations of regulatory evasion and state response
The report details technical obstacles that prevent regulatory oversight, asserting that Meta breaches the European Union Digital Services Act (DSA). Kondracki noted that Meta restricts bulk data downloads from its ad library and modifies scam advertisements post factum, replacing flagged fraudulent ads in the public repository with benign items like jeans or sneakers. Polish Deputy Minister of Digital Affairs Dariusz Standerski announced on social platform X that the ministry is analyzing the proposals submitted by Brzoska. Standerski stated that the ministry will work on developing and implementing measures that reduce internet fraud and increase platform liability.
