The Juvenile Court of L'Aquila issued a ruling establishing a phased reunification framework for Catherine Birmingham, an Australian former equestrian, and Nathan Trevallion, a British former chef. Under the terms of the decree, the parents are restricted to daytime visits conducted under the continuous oversight of social workers. The judges based these constraints on concerns that the parents sought to maintain ideological control over the children. The court also ordered that the couple's three children, comprising a set of twins and their younger sister, must be enrolled directly in the public school system. In response, Birmingham and Trevallion released a video statement on 5 September 2026 through their defence attorney, Simone Pillon, announcing their intention to file a formal legal appeal against the restrictions.

Our three children have been separated from home and their parents for ten months now, and now they will have to go back and forth without a clear perspective for their future, staying in a family home for who knows how long.

Disputes over schooling and medical warnings

The core disagreement between the parents and judicial authorities focuses on educational autonomy and child welfare. Birmingham and Trevallion argued that they submitted a detailed home education syllabus comparable to the instruction delivered during the children's stay in protective care. The couple stated that they moved to Italy specifically because national legislation recognises parental education, rural living, and family autonomy. In their statement, the parents also cited warnings from medical specialists overseeing the children, who reported that prolonged institutional placement placed their health in serious jeopardy. The parents contended that these medical recommendations, which urged an immediate return to the family residence, were entirely excluded from the judicial determination.

Off-grid residence and custody timeline

The legal intervention began in November 2025 when juvenile authorities suspended parental authority and removed the children from the family property in Palmoli, located in the province of Chieti. The couple had purchased the woodland plot in 2021, residing in a rural farmhouse that lacked running water and electricity, which social services classified as unsafe for minors. Following the removal, the children were transferred to a residential facility in Vasto, where Birmingham resided alongside them until March 2026. The defence team noted that the family had commenced construction work to adapt the property for the children's return. Pillon criticized municipal social services for administrative delays, pointing out that officials had not arranged coordination meetings between the court-appointed guardian, curator, and medical specialists.

Defense strategy and support network

Birmingham and Trevallion affirmed that they intend to maintain contact with regional institutions while pursuing their legal challenge. Their professional defence and support team includes psychologist Tonino Cantelmi, specialist clinician Dr. Aiello, and staff from the child neuropsychiatry division at Atessa Hospital. The forthcoming appeal will ask appellate judges to reassess the home-education programme and prioritize the medical documentation regarding the children's physical and psychological condition. The couple expressed gratitude to their medical and legal advisers, stating that public solidarity from families across Italy and abroad continues to assist their legal effort.
