
Experts rule 19-year-old suspect in Kędzierzyn-Koźle killing was legally insane
Forensic experts found 19-year-old Jakub L. had no capacity to recognize his actions during two attacks in Poland, prompting prosecutors to seek psychiatric commitment instead of a trial.
Expert evaluation on suspect's sanity
Court-appointed medical specialists determined that 19-year-old Jakub L. was completely legally insane when he carried out two violent attacks in the Opole region. The District Prosecutor's Office in Opole established a forensic evaluation team composed of two psychiatrists and a psychologist to examine the teenager. Following a single examination session, the expert panel determined without ambiguity that an underlying mental illness caused the total loss of his cognitive and behavioral faculties. The psychiatric findings prevent prosecutors from bringing formal criminal charges or seeking a prison sentence against the suspect.

Following the examination, the experts issued an unambiguous opinion. It shows that Jakub L. at the time of committing the acts had fully abolished ability to recognize their significance and direct his conduct, the source of which was mental illness.
The attacks in Opole and Kędzierzyn-Koźle
The psychiatric examination addressed two separate violent incidents that investigators combined into a single unified inquiry. The first attack occurred during the night between 4 and 5 July in Opole, where suspect Jakub L. attacked Jan K. and caused severe bodily harm. Seven weeks later, on 28 August, 49-year-old Diana R. left her home to walk her dog near the Żabieniec housing estate in Kędzierzyn-Koźle. A passerby walking in the local forest discovered her body around 18:00, located a few hundred meters from her residence. The victim's dog remained beside her body until authorities arrived at the scene.
Arrest and physical evidence
Investigators established that the assailant struck Diana R. five times in the head with a hammer before stabbing her in the abdomen with a knife. Police officers arrested 19-year-old Jakub L. on 2 September after identifying him as matching security camera recordings from the surrounding area. When detained, the teenager was roaming in the forest carrying a backpack stained with blood traces. Inside the bag, officers recovered a carpentry hammer and a survival-style knife matching the weapons used in the fatal assault. During subsequent interrogation, the 19-year-old confessed to both the fatal attack on Diana R. and the earlier assault in Opole.

Prosecution procedure and psychiatric commitment
Following the arrest, a court placed Jakub L. in temporary detention for an initial period of three months. Because the psychiatric evaluation established that the suspect lacked legal culpability, prosecutors confirmed that they will not submit an indictment to the court. The District Prosecutor's Office will instead petition the court to discontinue the criminal proceedings and order compulsory confinement in a closed psychiatric hospital under protective security measures. The investigation will continue for roughly three to four months to complete all procedural documentation before the file reaches the judge.

A person who has abolished sanity cannot bear criminal responsibility. However, therapeutic measures may be applied to them, including those related to compulsory placement in a treatment facility.
Next steps in the legal process
The Opole District Prosecutor's Office plans to finalize the formal investigation file across the coming months. Until the regional court hears the prosecution's motion and issues a formal ruling on psychiatric internment, Jakub L. will remain held under temporary arrest.
