Court decision and charges

Utah District Judge Tony Graf ruled that 23-year-old Tyler Robinson will stand trial for the fatal shooting of conservative activist Charlie Kirk. The decision followed a preliminary hearing in Provo, Utah, where Graf determined that prosecutors presented sufficient evidence to support all seven charges against Robinson. The counts include aggravated murder, illegal use of a firearm resulting in serious bodily injury, committing a violent offense in the presence of a child, and obstruction of justice. Robinson pleaded not guilty to all charges after the ruling.

Under Utah law, aggravated murder is the only charge eligible for capital punishment. The legal standard requires prosecutors to demonstrate aggravating circumstances, such as creating a grave danger to bystanders during the act.

Evidence and motive

Kirk, 31, was shot in the neck on 10 September 2025 while addressing a crowd of more than 3,000 people at an outdoor event at Utah Valley University in Orem. Utah County prosecutor Ryan McBride argued that Robinson fired a single shot from a rooftop more than 400 feet (about 122 meters) away using a bolt-action rifle.

“Tyler James Robinson shot and killed Charlie Kirk because he disagreed with him, and he did it by firing a high-powered rifle into a crowd of over 3,000 people, which created a great risk of death that anyone would know about.”

Prosecutors presented evidence collected during a five-day hearing in July, including DNA tying Robinson to the rifle and to a tool allegedly used to engrave the cartridge with the words "Hey Fascist! CATCH!". Investigators also cited a handwritten note addressed to his romantic partner stating an intention to target Kirk, as well as text messages and video testimony from his roommate, Lance Twiggs. Twiggs testified that Robinson tearfully admitted to the shooting the following day, stating that he wished he had not done it.

Defense arguments

Defense attorney Staci Visser sought to block the aggravated murder classification, arguing that the prosecution failed to prove that other people faced a high probability of harm. The defense maintained that Utah law requires a demonstrated risk to specific bystanders rather than a theoretical danger from firing toward an audience.

“There is one act. There is one shot. There is one bullet. There is one victim.”

Visser also challenged the validity of the prosecution's DNA analysis and contested the public release of Twiggs's interview, stating that public disclosure could compromise Robinson's right to an impartial jury. Judge Graf permitted the video and text records into evidence while restricting public viewing for specific segments.

Family reaction and next steps

Kirk founded the political advocacy group Turning Point USA in 2012, building a student network that later contributed to youth turnout in the 2024 presidential election. His widow, Erika Kirk, attended the Provo hearing alongside his parents, Robert and Kathryn Kirk. Robinson turned himself in to police following the shooting last September and could face capital punishment if convicted of aggravated murder.

The court scheduled a hearing for 23 October 2026 to set the trial date.
