Chinese court sentences artist Gao Zhen to three years in prison over satirical Mao Zedong statues

Sentencing in Sanhe

A court in northern China sentenced 70-year-old sculptor Gao Zhen to three years in prison on 25 August 2026 for creating satirical depictions of former Chinese leader Mao Zedong. The Sanhe People's Court in Hebei province found Gao guilty of infringing the reputation of heroes and martyrs, handing down the maximum custodial sentence available for the offense. Court officials did not release the verdict to the public and barred foreign observers from attending the proceeding. Diplomats representing the United States embassy in Beijing alongside other foreign missions traveled to the court facility in Sanhe to observe the sentencing, but security personnel refused them entry to the courtroom.

Retroactive application of legislation

The criminal prosecution centered on bronze sculptures and caricatures completed more than a decade before the statute used to convict Gao was enacted. Prosecutors presented three main works as evidence: the 2009 bronze statue "Mao's Guilt", which portrays Mao kneeling in repentance, the 2009 work "The Execution of Christ", depicting figures resembling Mao aiming rifles at Jesus, and the "Miss Mao" series featuring Mao with breasts and an elongated nose. The court ruled that Gao's sculptures exceeded the normal boundaries of art, asserting he created them out of resentment toward former leaders and distributed them overseas. China enacted its Law on the Protection of Heroes and Martyrs in March 2018 and revised it in 2021, while Gao produced the disputed works between 2005 and 2009 with his brother Gao Qiang.

Detention and impact on family

Gao, who relocated his residence to New York in 2022, was detained by security personnel at his suburban Beijing studio in August 2024 during a visit to see relatives. Authorities confiscated his artworks and held him in custody for two years before delivering the ruling following a one-day closed hearing in March 2026, where Gao pleaded not guilty. Chinese judicial rules credit pre-trial detention toward the final sentence, placing his scheduled release date in August 2027 if the decision is upheld. Gao's wife, Zhao Yaliang, and their seven-year-old son, who holds United States citizenship, have been barred from leaving China under exit bans since his initial arrest. Zhao had prepared clean clothes expecting his release before hearing the three-year penalty.

Ever since I learned of the verdict, I haven't been able to recover from it. It's devastating.

Diplomatic and international reactions

The United States Department of State voiced concern on 26 August 2026, stating that the prosecution relied on legislation that came into force years after the underlying works were created. State Department officials affirmed support for artistic expression and criticized Chinese authorities for blocking foreign diplomats from witnessing the verdict. Rights organizations condemned the sentence, with Chinese Human Rights Defenders researcher Shane Yi noting that Gao made the works as far back as 2005 and plans to appeal the verdict. Amnesty International China director Sarah Brooks stated that the lengthy detention and maximum sentence reflect an effort to deter independent creative work.

No artist should face criminal punishment for creating work that challenges official narratives or encourages critical reflection on history.
