Madrid judge dismisses slander lawsuit by Íñigo Errejón against Elisa Mouliaá

Court dismisses defamation complaint

Judge Arturo Zamarriego of Madrid Court of Instruction Number 9 has dismissed the criminal slander complaint filed by former Sumar parliamentary spokesperson Íñigo Errejón against actress Elisa Mouliaá. The magistrate notified the parties of the dismissal order on Wednesday, granting the request submitted by the defense team of Mouliaá. In the ruling, the judge determined that social media comments posted by the actress did not constitute a criminal offense because they represented personal opinions rather than specific accusations of criminal conduct.

It is clear that the respondent does not attribute specific criminal acts or conduct to the complainant.

Origins of the slander lawsuit

The dispute began after Mouliaá published messages on X, formerly known as Twitter, accusing Errejón of manipulating and extorting two witnesses called in a separate criminal investigation. Those two witnesses had organized the 2021 gathering where the alleged sexual assault took place. Errejón filed the defamation action after Mouliaá claimed publicly that he had communicated with the witnesses to alter their testimonies and refused to surrender his mobile phone.

Before initiating formal criminal proceedings, the legal representation of Errejón sought a pre-trial conciliation procedure and demanded 10,000 euros in civil compensation if Mouliaá did not issue a public retraction. Mouliaá rejected the conciliation offer, clearing the way for the former politician to file the formal lawsuit. Errejón maintained that the assertions made against him were entirely unfounded and caused reputational damage.

Justice is going to make her answer for so many lies and for so many defamations. And I only hope that happens sooner rather than later.

Procedural delays and court appearances

The proceedings experienced several administrative hurdles before reaching resolution. Judge Zamarriego issued an arrest warrant against Mouliaá after she failed to attend multiple scheduled court summonses to testify regarding the complaint. The actress eventually appeared voluntarily before the Madrid court on 24 June 2026, at which point the magistrate formally rescinded the arrest order.

In the end, this complaint is for having posted two tweets in which I accused Errejón of having rigged the testimony of two witnesses because at that time I thought it was like that.

Following her court appearance, Mouliaá stated that her social media posts were based on video footage of a witness describing conversations with Errejón about legal plans. The judicial decision to close the case ends the separate slander inquiry two months after her formal testimony.

Ongoing sexual assault proceedings

The dismissal of the slander complaint does not affect the primary criminal case pending against Errejón. Judge Adolfo Carretero continues to oversee the proceedings in which the former politician stands accused of sexual assault against Mouliaá at a private party in 2021. Mouliaá alleges that Errejón kissed her and touched her without consent inside the apartment of mutual friends.

Errejón has repeatedly denied the sexual assault allegations during judicial hearings, describing the complaint as false and motivated by bad faith. The controversy prompted Errejón to resign in October 2024 from all his political positions in Sumar, where he served as deputy, parliamentary spokesperson, and secretary of political analysis and discourse. He has since withdrawn from public life, limiting his appearances to mandatory judicial appointments in Madrid.
