
Australian court grants parentage in rare case of surrogate delivering biologically unrelated twins
The Children's Court of Queensland has approved separate legal parentage for twins born to a surrogate mother after she conceived naturally while carrying another couple's IVF embryo.
Dual pregnancy and unexpected conception
In September 2024, two Australian couples entered into an altruistic surrogacy agreement after being introduced through mutual acquaintances. The commissioning mother, identified in court documents as BNJ, was born without a uterus and was unable to carry a pregnancy with her partner, DRJ. A 27-year-old woman, identified as DZ, who already had five children with her husband FZ, agreed to act as a gestational surrogate. On 11 April 2025, a fertility specialist transferred a single embryo created from the commissioning parents' egg and sperm into DZ.
Ultrasound scans performed on 28 April 2025 and 12 May 2025 revealed two distinct gestational sacs and two developing fetuses. The surrogate had conceived naturally with her husband during the same period, contrary to medical guidance advising against unprotected intercourse around the time of embryo transfer. In November 2025, DZ gave birth to a boy and a girl on the same day via caesarean section. Genetic testing confirmed that the baby girl was the biological child of BNJ and DRJ, while the baby boy was the biological son of DZ and FZ.

Legal barriers under surrogacy legislation
Although both families agreed without dispute on who should raise each child, Queensland surrogacy rules created a regulatory obstacle. Under state legislation, multiple children delivered from a single surrogacy pregnancy are classified as birth siblings, and the statute prohibits separating them. Because DZ carried both fetuses simultaneously, transferring legal parentage of the girl to BNJ and DRJ while the boy remained with DZ and FZ required formal court approval. The proceedings took place at the Children's Court of Queensland under the legal citation BNJ v DZ [2026] QCHC 13.
To assist the legal proceedings, the families retained an independent counsellor to evaluate the psychological implications of raising the children in separate homes. The specialist assessment found that physical separation from birth was unlikely to cause psychological harm, provided the families maintained stable care and clear communication about the children's origins.
Judicial ruling and family arrangements
Judge Jodie Wooldridge delivered the decision on 21 August 2026, ruling that the infants were gestational twins rather than birth siblings under Queensland law. The court established that the statutory prohibition on separating siblings did not apply because the two infants shared no genetic relationship. Wooldridge granted parentage orders formally recognizing BNJ and DRJ as the legal parents of their biological daughter, while DZ and FZ retained full parental status over their biological son. In her written decision, Wooldridge addressed the importance of ongoing transparency between both households.
The parties understand that openness and honesty about the girl's origins and parentage will be in her long-term interests.
The court also noted that while the surrogate and her husband had not planned to conceive a sixth child during the medical procedure, the boy was loved and welcomed. The four parents have maintained regular contact over the past nine months and agreed to ensure both children understand their shared gestational origin as they grow older. Court records indicated no prior published cases in Australia with matching circumstances, citing the rare reproductive phenomena of superfecundation and superfetation.
