Spain's Supreme Court rejects PP bid to force urgent Senate appearances by ministers

The Vacation Chamber of Spain's Supreme Court rejected an urgent interim request by the Popular Party to compel cabinet ministers to appear before the Senate within 24 hours regarding the Ceuta migration crisis.

The Vacation Chamber of Spain's Supreme Court issued a ruling on Saturday, 22 August 2026, rejecting an urgent precautionary measure sought by three senators from the Popular Party (PP). The PP had asked the court to instruct the government to adopt all necessary organizational decisions within 24 hours to ensure ministers appeared in the Senate before the end of August. The court determined that the applicants failed to establish the statutory degree of urgency required to adopt an order without hearing the opposing side.

In its resolution, the judicial panel explained that handling the request through standard preliminary proceedings would not unduly delay the matter or compromise the senators' constitutional rights under Article 23.2 of the Constitution. The judges noted that only one week remained in the extraordinary August parliamentary period, while the public interest in the Ceuta border situation would persist regardless of the timing of the hearings.

In view of the arguments presented, it is not considered appropriate to grant the requested interim measure without a hearing, since the special urgency legally required to proceed in this manner at the expense of the other party's right to a hearing has not been established.

Origin of the legal dispute

The judicial conflict follows the absence of three key cabinet ministers from Senate committee sessions scheduled during the previous week. Foreign Minister José Manuel Albares, Interior Minister Fernando Grande-Marlaska, and Defence Minister Margarita Robles declined to attend committee meetings called by the PP, which holds an absolute majority in the upper house. The hearings were requested to examine the government's response to the arrival of more than 70,000 migrants in the autonomous city of Ceuta on 30 and 31 July.

PP leader Alberto Núñez Feijóo announced legal action on Wednesday after Robles left an empty seat in the Defence Committee, questioning whether ministers could lawfully refuse Senate summonses. The party submitted its administrative appeal on Thursday, arguing that executive accountability cannot be unilaterally redirected to the Congress of Deputies.

Opposition arguments and government schedule

In its filing, the PP argued that ministers possess a legal obligation under the Constitution and Senate regulations to attend committee summonses. PP Senate spokesperson Alicia García stated on social media that the party would continue pursuing legal avenues to enforce executive accountability.

The executive maintained that appearances would proceed through standard parliamentary scheduling during the final week of August. Defence Minister Margarita Robles is scheduled to address the Senate on Tuesday, followed on Wednesday by Minister for the Presidency and Justice Félix Bolaños alongside Health Minister Mónica García. On Thursday, Albares, Grande-Marlaska, and Migration Minister Elma Saiz are set to appear, with Youth Minister Sira Rego and Equality Minister Ana Redondo concluding the scheduled hearings the following Monday.
