Man detained in Marbella after stabbing transgender partner; case classified as domestic violence

The crime

A 58-year-old man was detained on Monday afternoon in San Pedro de Alcántara, a district of Marbella (Málaga), after confessing to stabbing his partner to death. According to ABC and Europa Press, the fatal argument occurred on Sunday, but the suspect spent nearly a full day with the corpse before alerting a neighbor on Monday. The neighbor then called the 112 emergency line at 16:15 hours. When National Police officers and medical services arrived at the apartment on Calle Castilla, the victim was still barely alive but could not be resuscitated. The suspect confessed immediately upon the agents' arrival, saying "La he matado" ("I have killed her"), and was arrested at the scene.

The victim was a 35-year-old transgender woman, though eldiario.es reports her age as 36. She presented at least one extremely serious wound to the thorax as well as other stab wounds, according to sources consulted by ABC. Her body was transferred to the Instituto Médico Legal de Málaga for autopsy. Some sources describe the suspect as approximately 59 years old (El Mundo, eldiario.es).

Legal classification and prior complaints

The case is being processed as domestic violence rather than gender violence because the victim had not legally changed her sex in the Civil Registry. The Tribunal Superior de Justicia de Andalucía (TSJA) explained that she had not acquired the legal status of "woman," which is why the investigation falls under a standard instruction court rather than the specialized gender violence court. The Marbella courts had never ordered the victim's exclusion from the Viogen gender violence victim registry, as that is a police database.

On August 1, both the suspect and the victim had filed mutual assault complaints against each other and were brought before the number 1 instruction section of the Marbella Court of Instance. Neither ratified the complaint, so the urgent proceedings were archived. The suspect is expected to be brought before the duty court of Marbella on Wednesday.

Political reaction

The mayor of Marbella, Ángeles Muñoz, led a minute of silence on Tuesday and expressed the city's "absoluto y rotundo rechazo" (absolute and firm rejection) of the violence.

Broader context in Andalucía

According to El País, this is the seventh woman murdered since June in Andalucía. The Ministry of Equality reported that, excluding this latest case, Andalucía accounts for 27.77% of all mortal victims of gender violence in Spain in 2026, about 10 points above its population share. Málaga alone holds 60% of Andalucía's mortal victims, approximately 40 points above its population weight. eldiario.es reported that before this case, 10 women had been murdered by partners or ex-partners in Andalucía in 2026, and 36 across Spain, the worst figure since 2019.

The Ministry of Equality has focused attention on Andalucía, where Vox holds the Justice portfolio after a coalition deal with the PP's Juan Manuel Moreno Bonilla. El País describes Vox as the only party with institutional representation in Spain that denies gender violence and did not sign the renewal of the State Pact against Gender Violence. The ministry's next crisis committee meeting will be held in September in Andalucía, the first time it convenes outside the ministry.
