German court sentences anaesthetist to 13.5 years for murder in child dental death
A Frankfurt regional court has sentenced an anaesthetist to 13 years and six months in prison for murder and attempted murder after administering contaminated drugs to four children at a dental clinic in Kronberg.
Retrial verdict at Frankfurt Regional Court
A criminal chamber at the Frankfurt Regional Court concluded the retrial of an anaesthetist on Thursday by handing down a prison sentence of 13 years and six months. The presiding judge explained that the former medical practitioner was guilty of murder as well as attempted murder in three separate cases involving child patients. The conviction for murder rested directly on the legal finding that the defendant acted with an intent to conceal his previous actions and treatment failures. The new decision replaces an earlier outcome from a separate chamber of the same court that had been set aside following an appellate review. The Frankfurt court noted that the newly delivered verdict is not yet legally binding.
Incidents at the Kronberg dental surgery
The criminal charges originated from treatments carried out in September 2021 at a dental practice located in Kronberg, in the Hochtaunus district. During procedures at the clinic, the anaesthetist injected contaminated anaesthetic medication into a total of four pediatric patients. The practitioner also committed additional egregious hygiene errors during the administration of the substances. The tainted medication triggered severe blood poisoning in all four affected children. A four-year-old girl died during the night directly in the dental treatment chair. Two other young patients, a boy and a girl, suffered severe medical emergencies and were admitted to the Frankfurt University Hospital. Both required artificial ventilation in intensive care and survived only narrowly.

Appellate review by the Federal Court of Justice
The case returned to Frankfurt after the Federal Court of Justice overturned the initial judgment upon review. In that first trial, a different chamber of the Frankfurt Regional Court convicted the former doctor of manslaughter alongside other offenses and handed down a prison term of ten and a half years. The public prosecution service assessed that penalty as insufficient for the severity of the conduct and filed a formal revision with the Federal Court of Justice. The federal court ruled in favor of the prosecution and ordered a new trial before a different chamber in Frankfurt, opening the way for murder charges to be reconsidered.
Arguments from the prosecution and defence
During the retrial proceedings, the prosecution demanded a sentence of life imprisonment for the German doctor. Prosecutors argued in their closing statements during the previous week that the anaesthetist sought to cover up his severe treatment mistakes and willingly placed the lives of the young patients at risk. Defence lawyers for the accused strongly rejected that interpretation of the events. They argued that an intention to conceal errors would logically have prompted the doctor to preserve the life of the four-year-old girl rather than trigger an intensive criminal investigation. The defence instead cited severe fatigue and work-related overexertion to account for the defendant's actions at the practice.
