Lublin court sentences man to six years for fatal assault and abandoning wife in freezing cold
The Lublin Regional Court handed down a combined six-year and one-month prison sentence to Michał M. for severely beating his wife and leaving her outside in freezing temperatures.
Regional court ruling and sentence
On 2 October 2026, the Regional Court in Lublin convicted a 48-year-old man, identified in proceedings as Michał M., in connection with the fatal beating of his wife, Paulina M. The court delivered a combined sentence of six years and one month of imprisonment following a trial conducted behind closed doors to protect the private interests of the victim's family. While prosecutors initially charged the defendant with homicide with conditional intent, presiding judge Piotr Łaguna modified the primary legal qualification to causing grievous bodily harm resulting in death. For this assault, the court imposed a six-year prison term, alongside an additional three-month sentence for the illegal production of alcohol.
The court consolidated the individual penalties under articles 85 and 86 of the Polish Penal Code into a single custodial term. Judge Piotr Łaguna cited the defendant's conduct and remorse during the trial as significant mitigating factors in setting the penalty.
As a mitigating circumstance, the court took into account the attitude of the accused during the proceedings, his remorse, and the fact that the accused felt responsible for his actions and took responsibility for his deeds.
Incident details in Dąbrowa-Kolonia
The fatal encounter took place in February 2025 in the village of Dąbrowa-Kolonia, located in the Trzydnik Duży municipality of Kraśnik County. According to court findings, the couple returned home in the evening after consuming alcohol at a gathering with acquaintances. A dispute began when the husband realized he did not have keys to their residence. Investigators established that the victim initially struck the man in the face during the altercation. The defendant, who weighed approximately 120 kilograms at the time, retaliated by pushing his wife at least twice against a wooden entrance door fitted with protruding wooden elements.
The force of the shove caused the victim to strike her head against the door and wall before falling onto a concrete pavement. The defendant then inflicted multiple severe injuries using an unidentified tool, causing rib fractures, skull fractures, and traumatic brain injuries. Rather than providing immediate aid, the defendant left his unconscious wife lying outside on the ground in sub-zero weather and walked to a relative's nearby home.
- Dispute occurs outside residence; defendant pushes and beats his wife before leaving her outdoors in freezing weather
- Defendant returns home, breaks open the door, drags his wife inside onto the floor, and covers her with a blanket
- Emergency responders measure victim's body temperature at 24.1 degrees Celsius and transfer her to the hospital
- Paulina M. dies in the hospital from head trauma and severe hypothermia
- Lublin Regional Court delivers combined sentence of six years and one month of imprisonment
Emergency response and medical findings
Later during the night, the defendant awoke, returned to the property, and forced the entrance door open. Unable to lift his wife onto the bed, he dragged her inside onto the floor and placed a blanket over her. Upon waking the following morning, he attempted to arouse the unresponsive woman and subsequently contacted emergency services. Paramedics arriving at the scene documented extensive cranial trauma and severe hypothermia, recording a core body temperature of 24.1 degrees Celsius.
The victim was immediately transferred to a regional hospital for intensive care. Despite medical efforts, she died from her injuries and hypothermia later that afternoon. Subsequent searches of the family residence by police officers uncovered equipment used for illicit alcohol production, leading to the secondary criminal charge included in the final judgment.
Prosecution stance and legal qualification
Following the verdict, prosecutor Małgorzata Dziedzic from the District Prosecutor's Office in Kraśnik stated that the court's reclassification of the charge aligned with the evidentiary record. She noted that cases involving fatal physical altercations often sit on the boundary between homicide and severe battery resulting in death.
In my assessment, regarding the legal qualification of the act, the court made correct findings.
The prosecution indicated that it has not yet made a decision regarding whether to lodge an appeal against the non-final ruling.
