Sparta Capital takeover terms
The legal action represented a final effort by British investment fund Sparta Capital, which acquired the debt-laden club for a symbolic one euro in late July from Spanish-Luxembourgish businessman Gérard Lopez. Owned by three French financiers, Sparta Capital partnered with investors Park Bench to assemble a restructuring plan. To satisfy regulatory requirements, the buyers placed 10.6 million euros into escrow at the Caisse des Dépôts to cover the budgetary deficit identified by the DNCG. The group had another 10 million euros in bank reserves for operations and pledged 20 million euros to settle existing liabilities.

Legal arguments and liquidation warning
At a hearing on 20 August 2026, legal representatives for Sparta Capital argued that their new financial guarantees proved the club's solvency and justified reinstatement to Championnat National 1. The administrative court dismissed these claims on sporting equity and procedural grounds. Following the verdict, lawyers Stéphane Bonichot, Pierre-Olivier Sur, and Thomas Clay warned that relegating Bordeaux to the sixth tier nullifies the acquisition plan and will lead directly to judicial liquidation. Bonichot criticized the French Football Federation for resisting the club's rehabilitation.

Reactions and emergency appeals
Club officials and staff expressed disappointment as the verdict arrived minutes before a scheduled pre-season friendly against Stade Bordelais. Director Arnaud Saint-André confirmed that management would review any remaining formal options while acknowledging the stance of French football authorities.
